USCIS issues more H-1B visas in 2021 as tech talent demand rises As per official reports, The U.S. administration has issued a comparatively higher number of H-1B visas in 2021 as the demand for tech talent in the U.S. is on the upswing.

Approval rates for H-1B visas in Q1, Q2, Q3 of the current Financial Year were 97%. During the previous administration, the H-1B visa approval rate stood at approximately 84% in 2018 and 2019.

The approval rate had earlier been comparatively on the lower side primarily due to 2 reasons:

  • rejections of H-1B visa applications, or
  • Requests for Evidence [RFEs], that is, asking for additional supporting documentation.

Industry experts are of the opinion that there are many reasons leading to a fewer number of RFEs. These include factors such as a change in the administration, and a settlement between USCIS and ITServe Alliance overturing 10 years of USCIS policies restricting H-1B visa holders and employers.

Consequently, the environment for legal immigration to the U.S. has undergone a change for the better in the recent 6 months.

What is the H-1B visa for the U.S.?
The H-1B is a nonimmigrant visa for the United States.

H-1B classification applies to individuals that intend coming to the U.S. for –

·         performing services in a “specialty occupation”,

·         services of exceptional merit and ability relating to a Department of Defense [DOD] cooperative research etc., or

·         services as a fasion model [of distinguished ability or merit].

The H-1B program is for companies in the U.S. that intend to temporarily employ foreign skilled workers in occupations requiring the theoretical and practical application of highly specialized knowledge.

H-1B specialty occupations include a wide range of fields, such as –

·         architecture,

·         medicine,

·         health,

·         law,

·         arts,

·         theology,

·         accounting,

·         physical sciences,

·         social sciences,

·         engineering

·         mathematics

·         education, and

·         business specialties.

Up to 65,000 H-1B visas are issued in a financial year by USCIS.

While around 2/3rds of requests for H-1B workers are for STEM occupations, the economic benefits of H-1B visas are not limited to the Tech Sector in the U.S. or the Silicon Valley alone.

There is a high demand for H-1B visas for workers in business, finance, healthcare, and life sciences industries.

As per official data – Nonimmigrant Visa Issuances by Nationality July 2021 (FY 2021) – there were a total of 2,049 H-1B visas issued in July 2021 to those with India as their nationality.
